Terms of Service

By accessing or using the MAAK Management takeoff marketplace at maakmanagement.com (the "Service"), including browsing listings, claiming a free takeoff, purchasing a takeoff, or submitting a private job request, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

MAAK Management provides construction quantity takeoffs — CSI MasterFormat-organized line items with quantities and units of measure, delivered as a spreadsheet, an online plan room (hosted by our technology partner, Verdic Systems, at a verdicsystems.com subdomain), or both. Takeoffs are a measurement service only; we do not provide pricing, bidding, engineering, or design services.

First-time customers may claim one takeoff free of charge. We verify a payment card with a $0 authorization hold to prevent abuse — you will not be charged for the free takeoff. One free takeoff per customer, determined by email address and/or the verified card. We reserve the right to deny or revoke a free claim we reasonably believe is fraudulent or duplicative.

All takeoffs are provided as a baseline estimate based on the drawing set dated as shown on each project listing. MAAK Management utilizes advanced digital measurement tools; however, the purchasing contractor is solely responsible for verifying that the takeoff corresponds to the most current and up-to-date set of issued-for-bid drawings, and for performing final verification of all quantities and field conditions prior to bid submission. Drawing revisions, addenda, or re-issued sets may affect quantities. MAAK Management assumes no liability for bid results or discrepancies arising from updated drawing revisions after the date noted on the takeoff.

A takeoff is a measurement aid, not a guarantee. You must independently review every line item, quantity, and unit of measure against the bid documents before relying on it for pricing, procurement, or contractual commitments. MAAK Management is not responsible for items omitted from a takeoff, misclassified scope, or errors that a qualified estimator's review would have caught.

Prices shown on the marketplace are in U.S. dollars and are charged in full at time of purchase via our payment processor, Stripe. "Coming Soon" listings have no price until bidding opens. We do not offer refunds once a takeoff file or plan room has been delivered, except where required by law or at our sole discretion.

Some takeoffs include access to an online plan room hosted by Verdic Systems (estimating.verdicsystems.com), a separate company and platform. Creating a Verdic Estimating account to access a plan room is subject to Verdic Systems' own Terms of Service and Privacy Policy, which govern that account and platform.

You may not: resell, redistribute, or publicly share purchased takeoff files or plan room access outside your own bidding organization; use the Service to submit fraudulent free-takeoff claims (including using multiple identities or payment methods to bypass the one-per-customer limit); or misrepresent your identity or company when requesting a private-job takeoff or purchasing a listing.

To the maximum extent permitted by law, MAAK Management's total liability for any claim arising from your use of the Service is limited to the amount you paid for the takeoff giving rise to the claim. MAAK Management is not liable for any indirect, incidental, or consequential damages, including lost profits or bid losses, arising from your use of or reliance on a takeoff.

We may update these Terms from time to time. Continued use of the Service after a change is posted constitutes acceptance of the revised Terms. Material changes will update the "Last Updated" date above.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
